Anthony J. Borrelli

Partner

A.J. Borrelli, a partner in the firm's Commercial Litigation Group, is a dedicated advocate who has handled a variety of litigation matters and has tried a number of cases to conclusion before judges, juries and arbitration panels.  A.J. also recognizes that the settlement prospects of every case require thorough evaluation and that it is paramount to understand the client's needs and expectations.

A.J.'s practice has focused on defending claims unique to the financial services industry, including claims for fraud, conversion, unsuitability, churning and unauthorized trading, as well as claims for investment banking fees, constructive discharge, defamation, bribery, breach of fiduciary duty and negligence.

Most recently, A.J. obtained the dismissal of claims seeking over $1 million for predatory lending, fraud and violations of the N.J. Consumer Fraud Act.  In support of his client’s position, A.J. pointed out that the law does not impose on lenders some “duty to warn” prospective borrowers of the risks inherent in borrowing.

Over his career, A.J. has obtained a number of favorable securities arbitration awards for the firm’s clients, including a “zero” award in a $1.6 million case in which the claimant alleged overconcentration in preferred stocks issued by, among other banks, Lehman Brothers.  He also obtained a “zero” award, and full expungement of the broker’s record, in a case in which the claimant alleged that his orders to liquidate his million-dollar investment portfolio during the financial crisis in October of 2008 were not executed.

A.J. also successfully pursued an appeal that upheld a party's ability to seek appellate review of a court order vacating an arbitration award. In a published decision, the Utah Court of Appeals decided a matter of first impression in the state (which only a handful of other courts around the country have considered) and agreed with the minority position advocated by A.J. on behalf of the firm's client.

A.J. also obtained a "no cause" verdict after a six-day jury trial in which the plaintiff claimed personal injuries, property damage and economic loss due to mold exposure.

Law and Politics Magazine named A.J. a Super Lawyers "Rising Star" in 2009, 2010, 2011 and again in 2012. He graduated Boston College in 1997 and received his law degree from Fordham University School of Law in 2000.
