Bankruptcy cases are far less likely to produce clear winners and losers than other forms of litigation. As Riker Danzig partner J. Alex Kress sees it, equitable solutions in bankruptcy matters require all parties to compromise. That is why he sometimes has to temper his role as an advocate in bankruptcy proceedings with that of a diplomat.

"I not only bring knowledge and experience to matters, but also a practical element," he says. "I try to help clients to get beyond their positions and see the reality of the situation they're faced with."

Alex's practice encompasses a broad spectrum of bankruptcy and reorganization work, representing creditors, debtors and trustees in bankruptcy cases. His clients include Wachovia Bank.

In recent years, he has been involved in a variety of telecommunications bankruptcy cases for both debtors and creditors. He represented AT&T as a creditor in a large case in the U.S. District Court for the Southern District of New York involving MetroMedia Fibernetworks, negotiating a variety of agreements between the parties.

Alex represented the successful appellant in two significant cases: In re Smart World Communications, Inc., 423 F.3d 166 (2d Cir. 2005) (involving standing under Fed R. Bankr. 9019) and In re United Healthcare System Inc., 396 F.3d 247 (3rd Cir.), cert. denied, ___ U.S. ___, 126 S. Ct. 62, 163 L.Ed. 2d50 (2005) (involving the priority of unemployment compensation reimbursement from a charitable institution). In Smart World, the appeal was followed by a twenty percent improvement in the recovery by the estate. In United Healthcare, the appeal increased creditors’ distributions by approximately 18 cents.

Alex has developed a unique niche representing indenture trustees for the benefit of bond holders in bankruptcy proceedings. He has also represented various parties in different aspects of asbestos insolvency cases.

Law & Politics magazine has named Alex one of New Jersey's "Super Lawyers" for bankruptcy law and Best Lawyers in America®, a peer review of U.S. lawyers, has named him one of the state's top bankruptcy lawyers.
