Scott Ohnegian, a partner in the Firm’s Employment Group, recently contributed to an article titled “Mandated Benefits” in the July 2010 issue of New Jersey Business. He was quoted with regard to the potential legal challenges employers face with respect to family and disability leave issues and the various State and federal acts they must adhere to.

Scott describes the techniques employers should use to avoid lawsuits arising from employees who may feel their job was unfairly revoked because they took leave or had to extend leave past the limits provided by the employer. As a precaution, he suggests that “an employer has an obligation to engage in what is called the interactive process…to determine whether a reasonable accommodation could exist, which would allow that person to do his or her job when they return.” Scott also warns that employers should seriously consider the impact that decisions based on individual employees regarding leave and other personnel policies may have on that particular employer’s ability to handle similar situations in the future.
